1. Contract Conditions

1.1 These terms and conditions (T&Cs) apply to all contractual relationships between the Municipality of Ferrera (hereinafter referred to as "Ferrera") and donors. Donors are defined as all individuals who make a donation to support the Magic Wood bouldering area. These T&Cs apply without restriction, and deviations must be in writing. By making a donation, the donor accepts these T&Cs.

1.2 The T&Cs of Ferrera apply to all donation campaigns and related services provided by Ferrera.

2. Purpose of Donations

2.1 Donations are collected to save the Magic Wood bouldering area from closure. The goal is to raise 230,000 CHF. If the goal is not reached, the collected funds will be invested where they are most urgently needed.

2.2 Donation amounts are individual, but each donor who contributes at least 10 CHF will receive a token of appreciation, which can be collected in the region. The token of appreciation can only be collected by showing the QR code stored in the profile at the collection point.

3. Data Security and Privacy

3.1 Ferrera stores personal data of donors in the context of the donation campaign.

3.2 All service-relevant data provided by Ferrera will be kept by Ferrera for at least one year. Further backup obligations can be agreed upon in writing.

3.3 Donors can decide at any time whether their information is published or not.

4. Donation Process and Payment Methods

To make supporting our project as flexible and user-friendly as possible, we offer three different ways to make a donation:

For registered users: If you already have an account with us, you can simply log in and make your donation. Your donation will be recorded in your account, where you can choose whether to remain anonymous. With the Magic Card associated with your account, you can collect your token of appreciation.

Account creation during donation: If you do not have an account yet, you can create one during the donation process by providing all required personal information. Your account will then contain your donation and the Magic Card for collecting the token of appreciation. You can choose whether your donation should be anonymous or publicly visible. This setting can also be changed later in your account.

Guest donation: You also have the option to donate as a guest. In this case, you remain anonymous but forgo the token of appreciation. For security reasons, we ask you to provide your name, address, and email address.

4.1 Payment Methods:

Regardless of the chosen donation method, payment is processed through our external partner Wallee. You can pay with Twint, PayPal, or credit card. Please note that no credit card information is stored on magicwood.app.

4.2 Refunds:

If for any reason you wish to request a refund of your donation, please contact the office of the Municipality of Ferrera (kanzlei@ferrera.ch) within 30 days (including donation number and donation confirmation PDF). Our team will address your request promptly. It will review whether a refund is possible or not and inform you within the usual processing period of 30 days.

5. Warranty and Liability

5.1 Ferrera commits to carrying out the entrusted services carefully, conscientiously, and responsibly. Ferrera commits to handling entrusted or confidential information accordingly.

5.2 Ferrera is not liable for defects and disruptions or operational failures of providers or third parties that are directly or indirectly relevant to the provision of services.

5.3 Furthermore, Ferrera is not liable for force majeure, improper actions, disregard of risks by the donor or third parties, excessive use, extreme environmental influences, interventions by the contract partner, their users, or disruptions by third parties (viruses, Trojans, etc.) that may occur despite the security precautions taken.

5.4 In the event of malicious attacks (e.g., by hackers, DOS attacks, etc.) on services created by Ferrera, Ferrera is not liable for direct or indirect damages, such as data destruction, data theft, or data disclosure.

6. Severability Clause

If any provisions of this agreement are ineffective or incomplete, or if fulfillment becomes impossible, the validity of the remaining parts of the contract shall not be affected. Ferrera and the donor agree to replace the ineffective provision with a permissible effective provision that comes closest to the original intention.

7. Applicable Law and Jurisdiction

The contractual relationships between the parties are governed exclusively by substantive Swiss law.
All disputes arising in connection with this contract are subject to the ordinary courts at the seat of Ferrera (Chur/Switzerland).
